Weak Hadith: The thief who steals repeatedly Hadith Sunan Abi Dawud 4410

First the only person who is infallible in delivering the message of Allah Exalted He is our beloved Prophet Muhammed peace be upon him.

No person else is infallible and does not make mistakes and errors, we as Muslims will not be embarrassed to acknowledge when someone makes mistake, we will not cover up to protect that person even if he is a famous sheikh or Imam.

Simply because the Truth is much more precious and appreciated in Islam before any individuals.

Some Basic Evidence from the Glorious Quran and Authentic Hadith conflicting with that weak Hadith:

โ€œThere has certainly been for you in the Messenger of Allah an excellent pattern for anyone whose hope is in Allah and the Last Day and who remembers Allah often.โ€

(Qurโ€™an 33:21)

โ€œAnd We have not sent you, except as a mercy to the worlds.โ€ (Qurโ€™an 21:107)

‘Aโ€™ishah (RAA) narrated that Allahโ€™s Messenger (peace be upon him) said:

โ€œThe blood of a Muslim is not to be shed except for three reasons: a married man who committed adultery, a man who kills another Muslim intentionally for which he must be killed (in Qisas or retaliation), and a man who abandons Islam and fights against Allah and His Messenger, in which case he should be either killed, crucified, or exiled.โ€ Related by Abu Dawud and An-Nasaโ€™i. Al-Hakim graded it as Sahih.

It was brought to our attention that Sunan Abi Dawood author Suleiman Bin Alasheuth Abu Dawood Alsajstani with the provisions of Al Albani t famous Page 791 in Arabic is rating the following hadith to be good (which vast majority of scholars classified it as weak):

The Weak Hadith:

Narrated Jabir ibn Abdullah: A thief was brought to the Prophet Muhammed (saw). He said: Kill him. The people said: He has committed theft, Messenger of Allah! Then he said: Cut off his hand. So, his (right) hand was cut off.

He was brought a second time and he said: Kill him. The people said: He has committed theft, Messenger of Allah! Then he said: Cut off his foot. So, his (left) foot was cut off. He was brought a third time and he said: Kill him.

The people said: He has committed theft, Messenger of Allah! So, he said: Cut off his hand. (So, his (left) hand was cut off.) He was brought a fourth time and he said: Kill him. The people said:

He has committed theft, Messenger of Allah! So, he said: Cut off his foot. So, his (right) foot was cut off. He was brought a fifth time and he said: Kill him. So, we took him away and killed him. We then dragged him and cast him into a well and threw stones over him.

There is No doubt that the above-mentioned weak hadith had been classified by vast majority of The Hadith Scholars to be very weak and odd, due to one of the individuals in the chain of narrations by the name of Musab ibn Thabit, hadith scholars described him not trustworthy in transmission of Hadith.

You need Arabic Langauge skills

To be able to check any hadith classifications you would need to hire an Arabic translator or copy the arabic text and use Google translate or be able to read and understand standard Arabic Language fluently to be able to read the following website http://hdith.com/

You do not have to be fluent in Arabic language to be Muslim, but if you want to be scholar of Islam, you will need to have high level of reading, writing and understanding of Arabic Language.

Which is one of the Hadith Database that will show you the authentic verified chains of narrators of Hadith and the classifications of hadith, whether a hadith is authentic, good, weak, or even fabricated.

We In Islam Compass, contacted Sunnah website regarding that weak hadith Sunan Abu Dawud, 4410 which is the topic of this article.

We have also contacted Imam Albani Center for Research and Studies in Jordan via their website here https://www.alalbany.org/ to alert them to that error in classification by Sheikh Albani.

Important Note regarding Arabic Language:

We repeatedly get these questions form non-Muslims why I need to understand Arabic language to know Islam very well. Does Allah understand Arabic language only?

Answer:

Well, The Noble Quran and Authentic hadith of our Beloved Muhammed are in Arabic language in the same language they were revealed and that is one of the MAIN reasons Islamic texts had been preserved.

Unlike the Bible, NO Christian has the full and complete original Bible in the original language that was revealed in, to Prophet Jesus Christ. Christians rely on translations of translations from the Greek Language.

Which basically relied on people who never ever seen Prophet Jesus by again relied on people who were not eyewitnesses to what had been claimed to the main evens of Christianity such as the purported crucifixion, resurrection etc.

If you want to drive a car you MUST abide by the Universal traffic rules even if you know how drive a bit. If you want to be a doctor again you need to learn some Latin language to learn medicine these are universal rules.

Another more example, if you want to use your computer at work, your employer must ensure that you are competent in using computers. You can tell your employer that you can use computers because you have been using calculators for some long, well good luck trying to convince your employer to trust you to use his computers without proper training.

Back to Scenario of the weak Hadith:

Just Imagine! Even after having that thief right hand get cut off, his left foot amputated, his left hand cut off, and finally his right foot amputated.

This man undeterred, was determined to steal!โ€ You really need to wonder not only about narrations like the one above but about the attitude that SOME of those who narrated that above-mentioned weak hadith had concerning our beloved Prophet Muhammed peace be upon him.

This underscores the importance of โ€˜matnโ€™ (the text) criticism, which is the core job of our scholars in the Science of Hadith field.

This above-mentioned WEAK hadith is in the collection of: Abu Daud Sulayman ibn Al-Ashโ€™ath ibn Ishaq al-Azdi al-Sijistani. 

Or some spellings have his name as Abu Dawood, Abi Dawood, Abu Dawud, Abu Daud.

Now you know what you are going to hear. You are going to hear that this above-mentioned hadith is classified as โ€˜hasanโ€˜ or good in Sunan Abu Dawood book, this article is about explaining that the hadith is not โ€˜hasanโ€˜ or good but weak.

What you most likely will not hear is that this at one point in the history of hadith classification there was no distinction between โ€˜hasan=goodโ€™ or โ€˜sahih=soundโ€™.

However, let us give our interlocutor some room to maneuver. Let us say that the above hadith is โ€˜daifโ€˜=weak. 

We say this because all too often today in many circles of learning in the Muslim world such a picture is painted of our beloved Prophet Muhammed, peace be upon him, that it seems that often what we find in the hadith is of another person entirely. 

Our Beloved Prophet Muhammed peace be upon him, the most benign, the most tolerate, compassionate, patient, lenient towards the creation of Allah (Exalted He)

It is a reckless, blasphemous behavior to include that weak hadith as Hasan=Good Hadith which in fact, vast majority of scholars have acknowledged that hadith to be weak Hadith due to untrustworthy narrator who transmitted such unreliable hadith that lacks the approval of authentic verified chains of narrators.

Did he think that this could possibly be an accurate portrayal of our Beloved messenger of Allah Prophet Muhammed peace be upon him?

Was the chain of transmission more sacred than the actual character of our beloved Prophet Muhammed (peace be upon him)?   

If the hadith โ€˜Superficially checked out, it was O.K. according to those who lack knowledge with the Science of Hadith narrations and whether it conflicts with the core beliefs as mentioned in the Glorious Holy Quran or Authentic Hadith or not.

Why is it that the character of our beloved Prophet Muhammed (peace be upon him) is so often sacrificed on the altar of isnad=narration by not multiple checking and verifying the chains of narrations over and over? 

We honestly trying to imagine scenarios where a person who has his foots and arms cut off was caught stealing. Maybe the readers can help us out. Admittedly at times we lack such wild imagination. 

Had any hadith reached us, we would think about what Allah (Exalted He) had said about his noble creation Prophet Muhammed (peace be upon him).

We would weigh it against the Glorious Holy Quran and other multiple authentic hadith that show our beloved Prophet Muhammed peace be upon him to be compassionate and kind and then we would have stood up in whatever circle of learning we were in and told the one narrating this to โ€œFear Allah!โ€ we would have left such a circle.

How would you speak such monstrosities about our beloved Prophet Muhammed (peace be upon him), we have repeatedly stated, In Islam we do not go by the saying of one Scholar, no matter how many qualifications and knowledge he had.

But we follow Islam as per the understanding of our beloved Muhammed peace be upon him and his companions, beside the agreement of vast majority of scholars who abide the glorious Quran and authentic Hadith.

Again, that weak hadith, portrays the companions of the Prophet did not act upon the initial explicit and direct commands of Prophet Muhammed (peace be upon him). 

Such above-mentioned hadith is portraying the Companions of the Prophet as if they were trying to negotiate with the Prophet what supposed to be said by the Prophet โ€˜kill him, referring to the thiefโ€™, and at the same time such scenario is portraying our beloved Prophet Muhammed peace be upon him in a very negative character assassinating manner.

But for those who grade that weak hadith as โ€˜hasan=goodโ€™ you have to wonder what they envisioned our beloved Prophet Muhammed (peace be upon him) to have been like. You must wonder how they see Islam being implemented in communities across the globe. 

Assuming the Weak Hadith is Correct for the sake of argument:

Anti-Islam would insist that the above-mentioned weak hadith is good while we Muslims know that it was erroneously stated in Sunan Abi Dawood author Suleiman Bin Alasheuth Abu Dawood Alsajstani with the provisions of Al Albani t famous Page 791 in Arabic.

Sunnah website sadly publication of this weak hadith as a Hasan=good hadith was based the above-mentioned book without double checking, here is the Weak hadith that had been listed as Hasan= Good Hadith by mistake.

We do not have any problems to acknowledge a mistake if we find it, providing there is crystal clear concrete evidence from the Glorious Holy Quran and Authentic Sunnah.

Hypothetically speaking, let us assume for the sake of argument that this weak hadith is correct, and it is accurate portrayal of our beloved Prophet Muhammed (peace be upon him).

If that weak hadith is correct that would necessitate the need to ask some basic logical questions such as following:

  1. How did the thief manage to stand rather than walk or move around to steal after firstly he lost his right, secondly lost his left foot?
  • Building on the above question, how for anyone to stand, walk or move around to steal after losing firstly right hand and secondly left foot?
  • Did that thief miraculously grow a right hand or at least the left foot to stand, walk or move around to complete his alleged crimes?
  • Perhaps that thief went to a hospital fifteen centuries ago in Mecca and had artificial limps surgeries instead of his left foot, right hand he lost?  (This is a sarcastic question).
  • If thief somehow was able to walk and managed to steal despite his right hand and left foot are cut off, wouldnโ€™t that make him a brazen ruthless criminal that anti-Islam should not sympathize with at all?  
  • Shouldnโ€™t anti-Islam feel sorry for the victims of that brazen thiefโ€™s crimes and support Prophet Muhammed and his companions who were trying their best to deter that ruthless notorious thief who was not deterred by losing his right hand, left foot etc.?

Finally, if that weak hadith is correct, it would be one of the true Prophethood signs of our Prophet Muhammed peace be upon him for the following reasons:

  1. Prophet Muhammed knew from Allah Exalted He, long time before the death of that thief that death would be his fate since that thief was not deterred by losing right hand, left foot etc.

It would prove such thief can not rehabilitated at all. For the thief to be hearing ongoing warnings that he will be killed several times and losing right hand, left foot etc.

Yet it did not deter him, rather he kept stealing. That would indicate his irreparable nature to be a good person. We all know that a thief can turn a killer in a matter of seconds.

  • If that weak hadith is correct that would indicate that the thief is not just normal thief but an armed robber who uses force to steal and rob people.

And if that is the case, that thief would fall under the following Quranic verse:

โ€œIndeed, the penalty for those who wage war against Allah and His Messenger and spread mischief in the land is death, crucifixion, cutting off their hands and feet on opposite sides, or exile from the land. This หนpenaltyหบ is a disgrace for them in this world, and they will suffer a tremendous punishment in the Hereafter.โ€ Quran (5:33)

  • As for burring the thief dead body after dragging his corpse and cast him into a well and throwing stones over him. That would indicate to us Muslims that the thief is relentless notorious criminal armed robber and non-Muslim.

And that death penalty was finally after the fifth time was ordered to protect the people from his continuous evils. (We still assuming this weak hadith is correct as enemies of Islam like to imagine).

Armed Robber can turn a killer in a second. By the way No instruction to deface or burn anyone died at the hands of Muslims even if he/she was the biggest enemies of Islam. It is very forbidden to burn dead bodies and cremation is forbidden in Islam as well.

  • Hypothetically speaking if that weak hadith is correct that thief would have had a funeral prayer organised by the Prophet and his companions if he was Muslim, as Muslims we owe every single dead Muslim a funeral prayer.

But since that Prophet Muhammed and his companions did not perform funeral prayer upon that dead thief, that indicates that the dead thief either was not Muslim or committed religious crimes made him ineligible to receive such funeral prayer, not only as notorious armed robber, but perhaps he was non-Muslim.  

Assumption that he is a thief and not an armed robber wouldnโ€™t justify his killing simply because of his repetitive stealing.

But again, armed robbery can potentially carry death penalty as stated in the qurโ€™anic verse:

โ€œIndeed, the penalty for those who wage war against Allah and His Messenger and spread mischief in the land is death, crucifixion, cutting off their hands and feet on opposite sides, or exile from the land. This หนpenaltyหบ is a disgrace for them in this world, and they will suffer a tremendous punishment in the Hereafter.โ€ Quran (5:33)

  • If that weak hadith is correct that would indicate that, our beloved Muhammed peace be upon him had been lenient, patient, gentle with a notorious armed robber who was most likely a non-Muslim since a funeral prayer was not conducted for him after his death.

Either the Prophet or his companions did NOT enforce the killing order until the FIFTH time- Again presuming that weak hadith is correct.

  • If that weak hadith is correct that would, portrays the companions of the Prophet did not act upon the initial explicit and direct commands of Prophet Muhammed (peace be upon him). 

We still hypothetically speaking: If that weak hadith is correct that would indicate that, Prophet Muhammed peace be upon him despite knew from Allah Exalted he the future fate of that notorious armed robber/thief.

Yet our beloved Prophet Muhammed peace be upon him warned him many times by his order to kill him. To scare that armed robber/thief to scare him make him give up on those crimes.

Which it would be a possibility if that thief chooses to repent, there is nothing would prevent him from repenting, despite his fate that was told to Prophet Muhmmed, that does not mean that the thief fate had been permanently sealed to be killed.

Allah Exalted he would accept him repentance and his fate would be a different positive one.

It is worth mentioning that those anti-Islam people can see how the so-called free world led by the United States have been violated international laws, violated United Nations resolutions, and went and killed millions of Muslims in Iraq under false accusations of owning weapons of mass destructions.

Which had been discovered that the Free world led by the United States knew in advance that they are lying and acting upon lies for the purposes of occupying Muslim lands and exploit its wealth such as oil, soil, water, and location as well.

Afghanistan is also no exception to the Free world aggression led by the United States, plus the chronic problem of Palestine as the whole world knows about that too.

Everyone knows how bad African Americans are treated so bad at the hands of the US white police officers and getting killed instantaneously on the spot the silliest reasons and sometimes for no reason.
